Is AI Safe? Data Security, GDPR, and What UK Businesses Need to Know

Every week, a business owner asks us some version of the same question: "Is it actually safe to use AI with our data?" It is a fair question, and the honest answer is: it depends on how you use it and which tools you choose.
AI is not inherently safe or unsafe. Like any technology, the risk depends on the implementation. A well configured AI system with proper data controls can be more secure than the spreadsheets and email attachments it replaces. A poorly implemented one can expose sensitive data in ways you did not anticipate.
This guide covers the practical considerations UK businesses need to understand. Not the theoretical risks that make good headlines, but the real, actionable steps that keep your data safe and your business compliant.
GDPR and AI: The Basics
The UK GDPR applies to AI just as it applies to any other technology that processes personal data. If your AI system handles information that identifies or could identify a person (names, email addresses, purchase history, health data, financial information), then GDPR rules apply.
The core principles are straightforward:
Lawful basis. You need a legal reason to process personal data with AI. For most business uses, this is either legitimate interest (the processing is necessary for a purpose you have a genuine business reason for and it does not override the individual's rights) or consent (the individual has agreed to their data being processed in this way). Be specific about what data the AI processes and why.
Data minimisation. Only feed the AI the data it actually needs. If your customer service chatbot does not need access to customers' full purchase history to answer delivery queries, do not give it access. The less data the AI touches, the lower the risk.
Transparency. People have a right to know when AI is being used to make decisions about them. If an AI system is scoring leads, assessing credit applications, or making any decision that affects an individual, they should be informed. This does not mean you need a pop up every time AI is involved, but your privacy notice should explain how you use AI and what data it processes.
Right to explanation. Under GDPR, individuals can request an explanation of automated decisions that significantly affect them. If your AI declines a customer's application or determines their pricing, you need to be able to explain the logic behind that decision in terms a human can understand.
Data subject rights. The standard GDPR rights (access, rectification, erasure, portability) apply to data processed by AI systems. If a customer asks what data you hold about them, the data in your AI systems is included. If they request deletion, that data must be deleted from your AI systems too.

Data Security Considerations
Beyond GDPR compliance, there are practical security questions to address when using AI tools.
Where Does Your Data Go?
When you use a cloud AI service (ChatGPT, Claude, Gemini, or any API based service), your data is sent to the provider's servers for processing. The critical questions are: where are those servers located? Is the data encrypted in transit and at rest? Is the data used for model training? How long is the data retained?
Most major AI providers offer enterprise plans that guarantee data is not used for training, is processed within specific jurisdictions, and is deleted after processing. These guarantees matter. If you are using a free tier ChatGPT account and pasting customer data into it, that data may be used for model training. If you are using an enterprise API with appropriate data processing agreements, the situation is entirely different.
Access Controls
Who in your organisation can access AI tools, and what data can they feed into them? This is often the biggest real world risk. An employee who copies sensitive customer data into a public AI tool is creating a data breach, regardless of how good the AI provider's security is.
Practical steps include providing clear guidance to staff on what data can and cannot be used with AI tools, using enterprise AI accounts with proper data processing agreements rather than personal accounts, implementing technical controls where possible (data loss prevention tools, approved AI tool lists), and training your team on data handling when using AI.
Data Processing Agreements
If you are using an AI service that processes personal data on your behalf, you need a Data Processing Agreement (DPA) in place. This is a legal requirement under GDPR, not optional. Most major AI providers offer standard DPAs as part of their business and enterprise plans. Review these carefully. Make sure they cover data location, retention, security measures, and breach notification procedures.
The EU AI Act and UK Implications
The EU AI Act is the world's first comprehensive AI regulation. While the UK is not directly subject to it post Brexit, it matters for UK businesses in several ways.
If you sell to EU customers or have EU based clients, AI systems you use in delivering those services may need to comply with the EU AI Act. The Act categorises AI systems by risk level: unacceptable risk (banned), high risk (subject to strict requirements), limited risk (transparency obligations), and minimal risk (no specific requirements).
Most business automation AI (chatbots, workflow automation, data analysis) falls into the minimal or limited risk categories. High risk classifications apply to AI used in areas like recruitment, credit scoring, and critical infrastructure. If your AI systems fall into high risk categories, the compliance requirements are substantial, including conformity assessments, documentation, and ongoing monitoring.
The UK government is developing its own AI regulatory framework, currently taking a sector specific approach rather than the EU's horizontal regulation. The UK framework relies on existing regulators (FCA, ICO, Ofcom, CMA) to apply AI principles within their domains. This means the specific requirements for your business depend on your sector and the regulators that oversee it.
Regardless of which regulatory framework applies, the practical advice is the same: use AI responsibly, document what you are doing and why, maintain human oversight for consequential decisions, and keep up with regulatory developments in your sector.
What to Look for in AI Vendors
When evaluating AI tools or service providers, ask these questions:
Where is data processed and stored? Ideally within the UK or EEA. If data is transferred outside these regions, appropriate safeguards (Standard Contractual Clauses or adequacy decisions) must be in place.
Is data used for model training? For any system processing your business or customer data, the answer should be no. Get this in writing.
What security certifications does the provider hold? Look for ISO 27001, SOC 2, or Cyber Essentials Plus as minimum standards. These are not guarantees of security, but they demonstrate that the provider takes it seriously.
What happens in a breach? The provider should have clear breach notification procedures, ideally committing to notify you within 24 to 48 hours. Under GDPR, you may need to notify the ICO within 72 hours, so you need to know quickly.
Can you delete data? You need the ability to request deletion of your data and receive confirmation that it has been deleted from all systems, including backups (within a reasonable timeframe).
Is there a DPA available? If not, walk away. Any legitimate AI vendor processing personal data will have a standard DPA ready.
Practical Steps for Your Business
Here is a straightforward checklist for using AI safely in your business:
Audit your current AI use. You might be surprised. Staff may already be using AI tools you are not aware of. Find out what tools are in use, what data is being processed, and under what terms.
Create an AI acceptable use policy. Document which AI tools are approved, what data can be used with them, and what is off limits. Keep it simple and practical. A two page document that people actually read is better than a 50 page policy that nobody follows.
Use business grade AI accounts. Ensure all AI tools used for business purposes are on paid plans with proper data processing agreements. Free tier consumer accounts are not appropriate for business data.
Update your privacy notice. If you are using AI to process customer data, your privacy notice should mention it. Be clear about what AI does, what data it uses, and the legal basis for processing.
Review vendor agreements. Check the DPAs for any AI services you use. Make sure they meet GDPR requirements and that you are comfortable with the data handling terms.
Train your team. Make sure everyone who uses AI tools understands the basics of data handling and your acceptable use policy. This does not need to be a formal training course. A 30 minute team session covering the key points is usually sufficient.
